PLEASE READ VERY CAREFULLY THESE TERMS AND CONDITIONS BEFORE JOINING MyPersonalEvent.com. PARTICIPATION IN MyPersonalEvent.com INDICATES THAT YOU ACCEPT THESE TERMS AND CONDITIONS. IF YOU DO NOT ACCEPT THESE TERMS AND CONDITIONS, PLEASE DO NOT REGISTER FOR OR PARTICIPATE IN THE MyPersonalEvent.com SYSTEM.

Introduction

This agreement ("Agreement") between You and MyPersonalEvent.com Standard Terms and Conditions ("Terms and Conditions"). "You" means any entity identified in an enrolment form submitted by the same or affiliated persons, who shall be bound by the terms of this Agreement.

1. This page tells you the terms of use on which you may make use of our websites whether as a guest or a registered user. The websites are operated by MyPersonalEvent.com ("we", "our" or "us"). Please read these terms carefully before you start to use our websites. You may only use our websites (and the services provided through our websites) if you agree to these terms. Your continued use of our websites indicates your acceptance that these terms apply to our websites and your use of them.

2. We may modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion by posting a revised agreement on our website (http://www.MyPersonalEvent.com).

Your Account

3. There is a charge for opening a MyPersonalEvent.com account and creating your standard wedding website, unless you have received notice from Us that you are entitled to a free site as part of our partner agreements. In addition to setup costs, there may be charges for other additional products or services supplied by us. You will be notified of these charges at the time you request the products or services.

4. During the registration process you will be asked to supply your email address. This will help us to verify your identity on future visits. Should you register using an invalid email address or an email address that belongs to someone else, MyPersonalEvent.com may terminate your account at any time without notice.

5. You will also need to provide a password in order to access your account and modify your wedding website. We do not permit you to share your password with any other person other than your fiancé. You must keep your password secure at all times. You will be responsible for any damage or losses caused by unauthorised access resulting from your failure to keep your password secure.

Prohibited Uses

6. You may not upload, email to us, nor utilise any images or other material, including text-based annotations and comments, which contain any of the following:

a: material which is defamatory of any person;

b: material which is pornographic, obscene, indecent or offensive;

c: material which promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;

d: material that is likely to incite hatred or violence against any person or group;

e: material that is likely to deceive any person;

f: blasphemous material;

g: material which concerns or relates to any criminal act;

h: material the use or inclusion of which infringes any copyright, trademark, database or other intellectual property right of any third party;

i: material made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence; material which promotes any illegal activity;

j: material which is threatening, abusive or invades another’s privacy, causes annoyance, inconvenience or needless anxiety;

k: material which is likely to harass, upset, embarrass, alarm or annoy any other person;

l: material used to impersonate any person, or to misrepresent your identity or affiliation with any person;

m: material which gives the impression that it emanates from us, if this is not the case;

n: material that advocates, promotes or assists any unlawful act such as (by way of example only) copyright infringement or computer misuse; or

o: material that breaches any applicable laws or legislation

7. You shall not, (i) display any Ad(s), Link(s), or Referral Button(s) on your MyPersonalEvent.com website that contains any pornographic, hate-related, violent, or illegal content; (ii) act in any way that violates any Programme Policies posted on MyPersonalEvent.com Web Site, as may be revised from time to time, or any other agreement between You and MyPersonalEvent.com; (iii) disseminate malware; (iv) create a new account to use MyPersonalEvent.com after we have terminated this Agreement with You as a result of your breach of this Agreement; or (v) engage in any action or practice that reflects poorly on MyPersonalEvent.com or otherwise disparages or devalues our reputation or goodwill.

Guarantees

8. Your wedding website will be available online for free for a minimum of one year after your wedding date has passed. After this time, we reserve the right to remove the site from the internet. If you would like your site to continue to be hosted online beyond the first year, please contact us via your control panel. We reserve the right to change a hosting fee for continuing to host your website after this time.

9. In addition, for the avoidance of doubt, we do not guarantee MyPersonalEvent.com will be operable at all times or during any down time (i) caused by outages to any public Internet backbones, networks or servers, (ii) caused by any failures of Your equipment, systems or local access services, (iii) for previously scheduled maintenance or (iv) relating to events beyond our control such as strikes, riots, insurrection, fires, floods, explosions, war, governmental action, labour conditions, earthquakes, natural disasters, or interruptions in Internet services to an area where our servers are located or co-located.

Limitations Of Liabilities

10. EXCEPT FOR ANY INDEMNIFICATION AND CONFIDENTIALITY OBLIGATIONS HEREUNDER OR YOUR BREACH OF ANY INTELLECTUAL PROPERTY RIGHTS AND/OR PROPRIETARY INTERESTS RELATING TO THE WEBSITE, (i) IN NO EVENT SHALL EITHER PARTY BE LIABLE UNDER THIS AGREEMENT FOR ANY CONSEQUENTIAL, SPECIAL, INDIRECT, EXEMPLARY, OR PUNITIVE DAMAGES WHETHER IN CONTRACT, TORT OR ANY OTHER LEGAL THEORY, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY AND (ii) MyPersonalEvent.com'S AGGREGATE LIABILITY TO PUBLISHER UNDER THIS AGREEMENT FOR ANY CLAIM IS LIMITED TO THE NET AMOUNT PAID BY MyPersonalEvent.com TO PUBLISHER DURING THE THREE MONTH PERIOD IMMEDIATELY PRECEDING THE DATE OF THE CLAIM. Each party acknowledges that the other party has entered into this Agreement relying on the limitations of liability stated herein and that those limitations are an essential basis of the bargain between the parties. Without limiting the foregoing and except for payment obligations, neither party shall have any liability for any failure or delay resulting from any condition beyond the reasonable control of such party, including but not limited to governmental action or acts of terrorism, earthquake or other acts of God, labour conditions, and power failures.

11. Representations and Warranties. You represent and warrant that all of the information provided by You to us to enrol in MyPersonalEvent.com is correct and current. (In addition, to the extent that Your Site is a media player (1) You represent and warrant that You have a valid license to use and distribute such media player (including all content therein) for the purposes of this Agreement and MyPersonalEvent.com; and (2) You shall ensure that any media player(s) that constitute the Site shall comply with the terms and conditions set forth herein. You further represent and warrant that each Property and any material displayed therein: (i) comply with all applicable laws, statutes, ordinances, and regulations; (ii) do not breach and have not breached any duty toward or rights of any person or entity including, without limitation, rights of intellectual property, publicity or privacy, or rights or duties under consumer protection, product liability, tort, or contract theories; and (iii) are not pornographic, hate-related or otherwise violent in content.

12. Your Obligation to Indemnify. You agree to indemnify, defend and hold MyPersonalEvent.com, its agents, affiliates, subsidiaries, directors, officers, employees, and applicable third parties (e.g. relevant advertisers, syndication partners, licensors, licensees, consultants and contractors) (collectively "Indemnified Person(s)") harmless from and against any and all third party claims, liability, loss, and expense (including damage awards, settlement amounts, and reasonable legal fees), brought against any Indemnified Person(s), arising out of, related to or which may arise from Your use of MyPersonalEvent.com, the Property(ies), and/or Your breach of any term of this Agreement.

13. MyPersonalEvent.com Rights. You acknowledge that MyPersonalEvent.com owns all right, title and interest, including without limitation all Intellectual Property Rights (as defined below), in and to MyPersonalEvent.com, and that You will not acquire any right, title, or interest in or to MyPersonalEvent.com except as expressly set forth in this Agreement. You will not modify, adapt, translate, prepare derivative works from, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from any of our services, software, or documentation, or create or attempt to create a substitute or similar service or product through use of or access to MyPersonalEvent.com or proprietary information related thereto. You will not remove, obscure, or alter MyPersonalEvent.com's copyright notice, Brand Features, or other proprietary rights notices affixed to or contained within any MyPersonalEvent.com services, software, or documentation. "Intellectual Property Rights" means any and all rights existing from time to time under patent law, copyright law, semiconductor chip protection law, moral rights law, trade secret law, trademark law, unfair competition law, publicity rights law, privacy rights law, and any and all other proprietary rights, as well as, any and all applications, renewals, extensions, restorations and re-instatements thereof, now or hereafter in force and effect worldwide.

14. Information Rights. MyPersonalEvent.com may retain and use, subject to the terms of the MyPersonalEvent.com Privacy Policy, all information You provide, including but not limited to Property demographics and contact and billing information. You agree that MyPersonalEvent.com may transfer and disclose to third parties personally identifiable information about You for the purpose of approving and enabling Your participation in MyPersonalEvent.com, including to third parties that reside in jurisdictions with less restrictive data laws than Your own. MyPersonalEvent.com may also provide information in response to valid legal process, such as subpoenas, search warrants and court orders, or to establish or exercise its legal rights or defend against legal claims. MyPersonalEvent.com disclaims all responsibility, and will not be liable to You, however, for any disclosure of that information by any such third party. MyPersonalEvent.com may share non-personally-identifiable information about You, including Property URLs, Property-specific statistics and similar information collected by MyPersonalEvent.com, with advertisers, business partners, sponsors, and other third parties. In addition, You grant MyPersonalEvent.com the right to access, index and cache the Property(ies), or any portion thereof, including by automated means including Web spiders or crawlers.

Services and Products

15. Once you have placed an order for any products or services through our websites (including any order for printing services), the order will not be treated as having been accepted until you receive confirmation from us that this is the case. This confirmation may be provided by email or post.

16. The decision as to whether to accept any order from you is at our sole discretion.

17. In the event that printed items are produced and prior to dispatch are then discovered to be in breach of these terms, we will not dispatch the printed items to you or to any guest who ordered the printed items. We may, at our sole discretion, refund all or a proportion of the payment made in respect of the order concerned but reserve the right to charge in full as if the printed items had been dispatched.

18. We will use our reasonable endeavours to reply promptly to all correspondence. Such reply may be by email or by post.

19. Payment will be made via the Paypal Payment Gateway, prior to dispatch of the goods.
